The two most precious resources for any small-business owner are time and money. That’s why when the subject of intellectual property comes up, many owners run in the other direction. They see images of expensive lawyers and use that as an excuse to ignore the topic, reasoning that it is a problem for big companies to worry about.

The trouble is, with the rise of competition through the Internet and on the global market, understanding intellectual property is more critical than ever for small-business owners. Let’s explore some of the common fallacies:

1. For small-business owners, it’s not worth the time or effort to secure intellectual property rights.

Daniel Lubetzky, chief executive of New York City-based Kind Snacks, had high hopes when he and his company attended the Natural Products Expo West in Anaheim, Calif., in March. And who could blame him, since his Kind Plus bars had been named the best new product at the Natural Products Expo East last October?

But it didn’t take long before Mr. Lubetzky knew something had gone wrong: He kept hearing how one of his competitors had copied the packaging, look and feel of his bars.

Fortunately for Mr. Lubetzky, he had secured crucial components of intellectual property like trademarks, trade dress (the look and feel of a product) and Web addresses after founding his company. Unlike a patent, which can cost up to $25,000 to secure, trademarks and Web addresses can be obtained relatively cheaply and without the aid of a lawyer.

With the legal documentation to back up his intellectual property rights, Mr. Lubetzky sent the offending company a cease-and-desist letter, which achieved the desired result. “Too many entrepreneurs forget there is more to I.P. than just patents,” said Mr. Lubetzky, who happens to be a lawyer.

2. Once I get a trademark, my brand is safe.

It may be. But consider what happened to Tracey Deschaine, who runs a restaurant called Dixie Picnic in Ocean City, N.J.

When Ms. Deschaine opened her business in 2006, she secured trademarks on her business name and logo and on the name of her signature item, “upcakes,” which are upside-down frosted cupcakes. The problem, she says, was that even though she had obtained the trademarks, someone monitoring the activity on the United States Patent and Trademark Office’s Web site had spotted her application and secured upcakes.com as the Web address, or U.R.L., before she could.

“I had no idea that even though I have a trademark, someone else could just go register the U.R.L.,” she said. “I wish I had planned ahead and bought the site before I did that.”

3. Having a patent gives me the right to produce something.

This is a very fundamental misunderstanding. Actually, what a patent does is give you the right to prevent someone else from producing what your patent covers. “Having a strong I.P. position helps ensure that other people pay you for your innovation like they would a toll on a road,” Mr. Kocher said.

But even if you do have a patent, there’s no guarantee that someone won’t try to get around it. There’s also no guarantee that you will win if you fight that person. But if you have your I.P. ducks in a row and a commitment to do whatever you can to defend those rights, you do have a fighting chance — even in a fight against a much larger company.

Consider the example of Cryptography Research, a 20-employee technology firm in San Francisco that specializes in data security. Beginning in 2004, the company made the decision to pursue litigation against the credit card giant Visa, which Cryptography asserted was infringing on its patents covering smart cards. To pursue the case against Visa, however, Cryptography’s founder, Paul Kocher, knew he needed a serious war chest in addition to his patent portfolio.

That’s why he decided to sell off another piece of his business, patents covering technology that protects Blu-ray discs from piracy, to Macrovision, which is now known as Rovi, in 2007 for $45 million. “All of a sudden we became a formidable opponent for someone who thought we couldn’t fight,” Mr. Kocher said. In the end, the gamble paid off, as the two companies settled out of court, with Visa’s agreeing to license the technology from Cryptography.

4. If I have a patent or trademark in the United States, I don’t need to worry about the rest of the world.

It depends on your business model. Intellectual property rights, which also include country-specific U.R.L.’s, need to be obtained country by country, some of which protect them better than others. The cost can vary, too.

In Japan, for example, it is notoriously expensive to acquire patents. In addition, the annual fees required to maintain the patents there are often prohibitively expensive for small businesses, said Gary Johnson, chief executive of Blue Spark Technologies, a manufacturer based in West Lake, Ohio, that makes small, flexible batteries used in things like radio frequency identification tags.

“What we have done is to develop a strategy to go after I.P. protection in a limited number of countries that we think we are most likely to sell or manufacture in, like the U.S. and China,” he said. “A lot of the choice comes down to what your business plan tells you.” To decide what your international I.P. strategy should be, consult a lawyer and conduct some cost-benefit analysis to see if expanding your I.P. rights makes sense.

5. People who collect patents but don’t actually make anything are “patent trolls,” parasites who can make money only by filing lawsuits against real businesses.

The term “patent troll” was coined in the wake of the epic lawsuit fought between NTP, a small holding company, and Research in Motion, which makes the hugely popular BlackBerry. The focal point of the dispute was a patent for wireless e-mail delivery held by NTP — something that R.I.M. eventually would pay millions of dollars to license. But what most people remember about the story is the lawsuits and the notion that NTP was somehow in the wrong for trying to enforce its patent, mostly because it didn’t make any products itself.

But consider that many inventors never set out to build a company, only to partner with someone who would bring their products to life. Thomas Edison, for instance, received more than 1,000 patents — many of which he licensed to other companies. “He created what we might consider the first innovation factory,” says Mark Blaxill a co-founder of 3LP Advisors, an intellectual property consulting company based in Boston.

A more recent example is Trident Design, a company founded by an inventor, Chris Hawker, which patented and then licensed the design for the PowerSquid. Like Edison, Mr. Hawker’s company invents products, builds an intellectual-property wall around them and then licenses them to other companies.

The PowerSquid is now manufactured by a division of Phillips Electronics and sold by a spinoff of Trident called Flexity. “Our entire business model is leveraging our I.P.,” Mr. Hawker said.

Farmville Tips and Hints – Plant Harvest Profits

This article will discuss the profit margins of each of the plants avaiable in Farmville and which is the most profitable for any given scenario.

Farmville Plant Harvest Profits:

So, I’ve been working though the levels in FarmVille and I’ve been surprised at how long soybeans remain the most practical. Below are the results of my findings. I will be updating this list as I am able to.

* in each of these cases, it is assumed the maximum number of harvests are done each day, a break down of each of these follows in the next table

The only reason I tend to recommend against these plants is that they are rather fragile in terms of how easily they can die. That is to say, if you do not harvest them in a timely fashion you can lose the entire crop. that’s why I prefer to stick with wait times which are 1 day or longer. However, if you can keep these harvested on a regular basis, they have a higher potential then most of the other plants.

Explanation of Tables

Because there has been some confusion with regard to the above tables. I’ve added this section to help explain what the numbers in each column represent.

Cost: This is how much it costs to plant this kind of seed in an already plowed field. This is the listed price and it does
not take anything else into consideration

Sell Price: This is how much money you get when this plant is harvested. This is the listed price and does not take any
other factors into consideration.

Time (days): This is how many days it takes for the plant to mature. For plants which mature in less then one day a value less then 1 will be displayed. These values are arrived at with the following formula.

Time (Days) = Time(hrs)/24

Weekly Profit: This is how much money you would make if you planted the same crop and harvested it at the same time every day for a week. It should be noted that a farmville day is 23 hours. The reason this is listed is because it may be impractical to harvest every 23 hours, since this would result in having to harvest it one hour earlier every day. Additionally, these numbers take into account the plowing cost of 15. The formula used is as follows.

Weekly Profit = 7 x ((Sell Price – (Seed Cost + 15)) / Time)

Weekly Profit: This is how much money you would make if you planted the same crop and harvested it as soon as it was ready and did this for a week. Keep in mind that this is the theoretical maximum and unless you’re willing/able to harvest at all hours of the day your number will end up being slightly lower. Because plants that take less then one day were already on an hourly basis the formula is only altered for those plants with harvest times of 1 day or longer.  The formula is as follows

Weekly Profit =  7 x 24 x ((Sell Price – (Seed Cost+15)) /(Time *23))

Hopefully, this will help everyone understand the above tables. While it’s true that I do not actually list the plowing cost of 15 anywhere in the tables. They do take it into account.

The most profitable plant to harvest:

Assemble up your Facebook Farmville account by planting strawberries only. Complete this task at least 3 times a day for the first four days. Add more plots of strawberries as you progress the levels and can afford it. Don’t purchase anything but the berries to grow.

Plant the entire field with strawberries day after day for as many times as you possibly can on Facebook Farmville. Once you can use your whole plot (12 squares by 12 squares= 144) for berries you are spending 1440 but earning 5040 a pop so your profit is 3,600 (earnings-cost=profit). Deposit the berries like this three times a day for the 4 days and you have $57,600.

Keep progressing upwards in dollars by planting strawberries and you will see the results add up quickly. Expand your farm plot quickly by adding neighbors and getting the experience.

Some may wonder why sow berries only on Facebook Farmville when they are the cheapest to purchase and the lowest in return. Do the math here folks in the time you can plant and harvest artichoke with a sell price of $204 dollars you can plant and harvest 24 berries plants where you will profit $600 bucks. That is for one square. Imagine if you planted all 144 squares with berries.

To place 144 squares of strawberries on Facebook Farmville, you will spend $1,440 and sell for $5,040 dollars with a profit of $3,600 for the four hours it takes to ripen.

If place the Artichoke that will cost you $10,000 and you sell them for $29,376, which looks great, but it takes four days to harvest these. You can replace harvest a field of strawberries 24 times in the period that it takes those artichokes to mature.

Multiple 24 times the profit of 3,600 you get per harvest of strawberries and get 90,000. I would rather do the red-berries because I can triple my money easily.

The artichokes harvest in 4 days while the red-berries ripen in 4 hours in the game Facebook Farmville. Therefore, you can plant the same plot of strawberries 24 times in that 4-day period and profit $636 more with the same plot.

Strawberries ripen and are ready for harvest in 4 hours. Pick them quick or you will lose thousands of cash. Do this right, follow the outline I have laid and you will turn out to be a very rich farmer in no time at all. You will develop into the richest farmer on Facebook Farmville and be the envy of all your friends.

GED: The Key to Better Jobs and Higher Education

Recently, a student wrote on a GED message board: “I was told over and over again when I was growing up that I am stupid and don’t amount to anything.” This student’s brother tells her that only losers get a GED, and that if she wasn’t a loser, she would have finished high school. Unfortunately, this is the kind of experience that many young people have in life. Without support, they fail in high school and drop out, leaving millions of American adults with no high school diploma. The brother’s response puts her in a no-win situation, basically saying that she’s closed all the doors open to her, and now she can only be a “loser.”

Far from being something for “losers,” the GED is a chance for people to turn their lives around. Staying in the same place, with a low paying job, or no job at all, and low self-esteem is not the answer. The GED is the path to get back on track, and one of the best roads it can lead to is college.

Recently, three students who earned their GEDs at New Mexico State University were profiled in the Cibola Beacon. All three have gone on to succeed in college, on their ways to new careers. Stefanie Grandjean, mother of a seven-year-old daughter, is studying to become a nurse with a graduate degree, as well as teaching math to other students studying for their GEDs.

Arnold Davis also works for the GED program where he studied for his GED. He is studying for a degree in automotive mechanics and is active in student government. His future goals include earning a degree in social work. Sandra Daily, who earned her GED in 2006, already has an AA in general studies and is planning to get a degree in fine arts. Over the course of three months, she went from grade-school level to being ready for college.

The GED is a step forward, toward more confidence, higher education, and better jobs. It is a path toward tearing down those walls built up by voices saying, “You’re stupid.” Just succeeding at the GED goes a long way toward students regaining belief in themselves.
