If you were to die, you have life insurance so that your family is taken care of financially, your debts are paid off, and your funeral costs are covered. Likewise, you maintain automobile insurance just in case your car needs repaired due to theft, accident, or other reasons. Most of us also have health insurance because we need to be healthy to pay for all of the above.

Without a doubt, you are much less likely to use your homeowner’s insurance policy due to home damage than you are to have a legal issue unless you have a child that likes to play with matches a lot. However, every month you gladly pay the premium for your home to have the protection it needs. It is a no brainer to make sure your house is covered and it should be the same from a legal standpoint. In today’s litigious society, it can be easy for the nursing staff to become involved directly or indirectly in legal matters. However, just as the amount of cases has increased, there are some common themes among legal battles involving nursing practitioners that have stood out. By understanding some of the issues at work, nurses can avoid many of the trouble or high risk areas that might create future legal situations. Over-stressed and exhausted individuals can make errors which could develop into legal entanglements. Though, with today’s nursing shortage, longer hours and increased patient load may be unavoidable. Here are a few areas in which nurses could possibly be placed in a legal situation.

Negligence

Obviously, if a nurse is neglecting the patients in his or her care, the nurse can be held responsible for the negligence. Negligence is the failure to take an action that should be attended to. Medication not administered, care not given, supervision not provided-all of these things may qualify as negligence. A patient has the right to expect that a certain level of care would be provided to them. If this level is not maintained, the patient may have grounds for pursuing legal action to remedy the results of the negligent activities.

Malpractice

As opposed to negligence, malpractice is doing something wrong when it was reasonable to expect that the activity would be done correctly. For example, if a nurse does range of motion movements on a patient incorrectly and causes additional strain or pain to the joints, this might be considered malpractice, since it is to be expected that a nurse would be trained in doing such tasks correctly. It does not matter why the malpractice occurred, but it can be the result of fatigue or incomplete or inadequate training. Malpractice is tied to legal risks in many hospital settings each year, although it is more commonly thought of in connection with doctors than nursing staff.

Accidents

An accident is an unforeseen circumstance that is not necessarily due to negligence on the part of the nurse. An accident might occur if a nurse’s action is done incorrectly with full knowledge of the correct way to perform the task. An accident could also occur if a patient who is allowed to be out of bed without supervision slips and falls. Although it is a legal risk, this scenario may not be as difficult to defend as negligence or malpractice. However, since the victim may be looking for someone to blame for their misfortune, the nurse may very well be tied up with legal issues in this particular situation.

The Actions of Another

If the actions of other personnel or staff fall under the heading of negligence or malpractice and it is not reported, you may potentially be held accountable for legal implications resulting from negative activities. If a nurse knows of a co worker who is abusing drugs, for example, and that nurse allows that activity to continue, the nurse can be held responsible for any harm that is caused while that nurse was under the influence. If someone under a nurse’s supervision is not adequately trained in transferring patients, that nurse has some responsibility to encourage them to learn the missing skills. This is to protect the patient and the staff member from injury.

Documentation

One of the greatest legal defenses a nurse has is to always document properly. This can work the other way as well though, and a nurse can be held responsible if there are documentation errors. The patient’s charts are the legal record of actions taken medically on their behalf. It is critically important that such records be complete and accurate. If there is a controversial order on the chart, in the view of the nurse, then it would be wise to verify. Legal risks are higher if the charting is done incorrectly, or inadequately.

Certification and Licensing

A nurse that does not have current certification and licensing may become involved in legal entanglements, particularly if any other activities attract the attention of the authorities. Practicing medicine without being properly trained can be dangerous for the patient, but can result in huge fines and even prison time for the person who is found guilty of such acts.

These examples represent occasions when a nurse may be involved in activities that cause risk legally either to the nurse or the other medical staff in the facility. Different types of nursing situations may be more prone to risk than others. For example, a hospital setting may be more likely to have certain types of legal risks. Home health care may display another type of risk, while nursing home care may represent another entire group of risk factors.

The Only Conservative Candidate Speaking Up for Christianity and Against Gay Marriage in Church

In the current 2008 presidential field, there are many walking contradictions that have very little appeal to the conservative movement.

The first Christian candidate to evaluate is Rudolph Giuliani. He is a born Catholic and attends services regularly.

However, Giuliani believes that while abortion is personally wrong, the government should not make it illegal, hardly a position that sits with evangelicals.

The next leading Christian candidate is Mitt Romney. He is a member of the Mormon Church, but has not been denounced by the evangelical community because of his Mormon faith.

During Romney’s term as Governor of Massachusetts, the state became one of the first states to legalize Gay Marriage. During Romney’s bid for US Senate, he openly supported the Log Cabin Club of Massachusetts, a group that openly supports Gay Marriage.

As far as the rest of the field is concerned, John McCain has been known as a flip-flopper on many issues. No one really knows what Fred Thompson stands for but he does have a moderate track record.

The rest of the conservative field has yet to draw any media coverage.

However, since the announcement by Michael Bloomberg, more and more Americans are now starting to look at third party candidates.

During a recent campaign stop, 2008 Presidential Candidate, Daniel Imperato, addressed these very issues.

Imperato declared gay marriage in churches to be an “abomination.” He continued by saying that the government ought not to be able to prevent two people from entering into a contract with each other.

“Gay marriage should not be allowed or confirmed in churches. I stand on the grounds that marriage is between a man and a woman,” stated Imperato.

Imperato is a “man of faith” when asked about his Christian denomination. He was raised a Catholic, but has embraced the evangelical Christian community, as well as the Messianic Judaic community.

Imperato is also Papal Knight with Honors from Pope John Paul II and the Vatican.

Recently, Imperato has also spoken out against removing religious epithets such as “In God We Trust” from our printed money, and the Ten Commandments from government buildings.

“The fact of the matter is that, the Ten Commandments only promotes good and not evil. We should not be wasting taxpayer money to remove these items, or to protest these items. Displaying the Ten Commandments, or printing “In God We Trust” on money, does not cause anyone any harm,” stated Imperato.

In a crowded race of 2008 Presidential Candidates, it is the independent who is blazing a trail amongst Christians and conservatives alike.

As the 2008 Presidential race draws nearer, what better way to bring conservatives and Christians to the polls than to show the parties that turned their backs on them, that the American people have the power by voting for an independent.

Patent and Copyright Infringements

You may have found booths that had been closed down and sealed and you thought it strange. At all international Trade Fairs it is common practice on the first day for lawyers or other legal representatives from manufacturers of famous brand names to swarm the exhibition hall and check for the following details:



Copyright violations

Patent infringements

Has the factory obtained the required licenses; for instance for DVD players

Has the factory paid the necessary licenses; for instance MP3 players



 

Especially in Europe and the United States, any copyright or patent infringement will be dealt with. Even if the supplier showed a product at their booth (trading company) that was not manufactured by them, they will be held responsible.

Usually the products will be confiscated and the exhibitor will receive a court order and has to pay a fine. In severe cases like a DVD player w/o a valid license, the booth will be immediately closed and the manufacturer could even face arrest if there is a risk that he will try to escape.

I just want to draw your attention to this and make you sensitive to copyright or patent infringements. Chinese companies sometimes have a different understanding of copyright or patent laws.

They will buy an attractive branded product from overseas and copy it by adding several minor modifications. Now they believe it is their own design. They will even register these products at the Beijing Patent Registry as their own design.

If you ask them during your meetings whether it is their own creation, they will tell you it is and they have even registered it.

Don’t Make This Mistake

However, their registration means nothing if you import these products to your home country. In all probability you will be caught and have to pay severe penalties or compensation payments to the brand name owner.

We are not talking about small change here. Sometimes this can run into hundreds of thousands of dollars.

It can even happen to you long after you have imported the products and forgotten about them. It is common practice that the brand name owners wait some time before pursuing their legal cases because in the case of patent infringements more compensation money can be retrieved that way.

Do yourself a favor and avoid manufacturers that practice this kind of business for your own protection.
